Application Terms of Use

 

The rules applicable to the use of the Fly Butterfly App provided by Smart Shark Creative Studio, headquartered in the city of Guarulhos, (hereinafter “Smart Shark Creative Studio”), on mobile devices with Android systems initially are described below.

 When registering to use the Application, the User will automatically submit to the rules and conditions of these Terms of Use.

 

1. DEFINITIONS

 

1.1. App or mobile application: is software designed to be installed on a mobile electronic device, such as a cell phone, a smartphone. This application can be installed on the device, if the device allows it and as long as it is downloaded by the user through an online store, such as Google Play or Apple Store, among others.

 1.2. Android: is an operating system for mobile devices, developed by the ''Open Handset Alliance'', led by Google.

 1.3. iOS: is a mobile operating system by Apple Inc originally developed for the iPhone.

 1.4. Push Technology: it is an Internet content distribution system in which information leaves a server for a client, based on a series of parameters established by the client, also called “subscription”. In the case of this Term of Use, it is content to be sent as alerts, reminders or messages to the user who has the Fly Butterfly application installed.

 1.5. Users: All people, without restriction, will be able to download and use the Fly Butterfly application. Users will have access to the resources:

• Input screen;

• Store screen with items for purchase;

• Game scene.

 

2. DOWNLOAD THE FLY BUTTERFLY APP

 

2.1. In order for the user to be able to download the application on his mobile device, he must make sure he has Android. There will be no other way to access the Fly Butterfly App other than via smartphone.

 2.2. The “Term of Use and Privacy Policy” to users is present in the links and the user can review them at any time.

 

3. THE FLY BUTERFLY APP FREE OF CHARGE AND BILLING

 

3.1. There will be no cost for using and downloading the Fly Butterfly App, nor for any updates.

 3.2. for the user who wants to purchase the products contained in the ingame store, he must make the purchase directly through the application, respecting the privacy policies and terms of purchase of google which can be accessed by clicking on this Google Play Services link.

 

4. REGISTRATION AND USE OF THE FLY BUTTERFLY APP

 

4.1. At the moment, no registration is necessary to use the application, but in future updates there may be changes in the way of accessing the application in order to improve the user experience.

 4.2. In the future, the user who registers his personal information will be responsible for the correct filling and maintenance of said information. The “Registration” consists of mandatory data such as name, email and password to access the Fly Butterfly application.

 4.3. A single registration per User will be allowed, and access, viewing and use of the Application must be made by the User on a personal and non-transferable basis.

 4.4. In the case of minors under 18 (eighteen) years of age or other persons who require representation under the law, registration must be carried out with the assistance of parents or legal representatives.

 4.5. It is not the responsibility of Smart Shark Creative Studio if a User uses the registration of another user.

 4.6. Any and all actions performed or content posted by the User while using the application will be their sole and entire responsibility, and shall exempt and indemnify Smart Shark Creative Studio from any claims, losses, losses and damages caused as a result of such actions or manifestations.

 4.7. The User authorizes Smart Shark Creative Studio or third parties indicated by it, to use, for an indefinite period, the information provided at the time of registration and during the use of the application, for statistical purposes and sending advertising material, newsletters, reports, etc. .

 4.8. Smart Shark Creative Studio reserves the right to include, exclude or change the contents and functionality of the application, as well as temporarily suspend or cancel it, at any time, regardless of prior notice to the User. Likewise, you can modify these Terms of Use, the latest version of which will always be available for consultation through the link or directly in the application.

 4.9. Smart Shark Creative Studio disclaims any and all liability for damages of any nature that may arise from access, interception, deletion, alteration, modification or manipulation, by unauthorized third parties, of user data while using the application.

 4.10. The information requested from the User at the time of registration will be used by Smart Shark Creative Studio only for the purposes set out in these Terms of Use and under no circumstances will such information be assigned or shared with third parties, except by court order or competent authority.

 

5. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

 

5.1. Smart Shark Creative Studio is responsible for its services and the management of the application in relation to users, however, the quality and quantity of the products and services offered by our partners is the sole responsibility of the latter.

 5.2. The User is responsible for updating the Fly Butterfly App. If you fail to do so and you have a problem using it, Smart Shark Creative Studio will be exempt from liability for any loss or damage.

 5.3. Smart Shark Creative Studio does not represent or warrant that the Application will be free from loss, defects, attacks, viruses, interference, hacking activities or other security intrusion, and Smart Shark Creative Studio disclaims any liability with respect thereto for be someone else's fault.

 

6. INTELLECTUAL PROPERTY

 

6.1. The User agrees that the services provided by Smart Shark Creative Studio, including, without limitation, the Application with user interface, integration with other services or applications, scripts and software used to implement it, contain proprietary information of Smart Shark Creative Studio. and/or its licensors and are protected by intellectual property and other applicable laws, including, without limitation, copyright.

 6.2. The User agrees that he will not use such proprietary information or materials in any way, except to use the Services in accordance with these Terms of Use. No part of the Services may be reproduced in any form or by any means, except as expressly permitted by these terms.

 6.3. Without prejudice to any provision of this Term, Smart Shark Creative Studio and its representatives reserve the right to change, suspend, remove or disable access to the application, content or other materials, at any time, without notice or charge. Under no circumstances will Smart Shark Creative Studio be held responsible for having made such changes. Smart Shark Creative Studio may also impose limits on the use of or access to certain features or parts of the application's service, in any case and without notice or liability.

 6.4. All copyrights relating to Fly Butterfly and related software are owned by Smart Shark Creative Studio or its licensors, who reserve all rights under law and in equity. The use of the software or any part of the Fly Butterfly App services, except for the use permitted in this term, is strictly prohibited and violates the intellectual property rights of third parties, and may subject you to civil and criminal penalties, including possible property damage for copyright infringement.

 

7. CANCELLATION

 

7.1. The user may, at any time, uninstall the Fly Butterfly App, without this giving either party the right to compensation or any other amount.

 7.2. Without prejudice to other legal sanctions and those provided herein, Smart Shark Creative Studio may, at its discretion, notify, suspend and/or cancel the User's registration, terminate this Term and/or Account, revoke the software license, prevent access to the application (or any part thereof) at any time, definitively or temporarily, in the following cases, exemplifying, but not limited to:

 1.a) Failure to comply with any provisions of these Terms of Use;

2.b) Verification of duplicate registration;

3.c) Verification of a new registration performed by a User whose registration was canceled and/or suspended;

4.d) Confirmation of fraud or attempted fraud; and/or,

5.e) Providing incorrect and/or untrue information requested or refusing to provide any additional information requested by the Site.

 7.3. With the termination, for any reason, of the relationship between Smart Shark Creative Studio and the User.

 7.4. Smart Shark Creative Studio reserves the right to change, suspend or discontinue the Fly Butterfly App (or any part or content) at any time, with or without notice, and Smart Shark Creative Studio will not be liable to the User or any third party. if you exercise such rights.

 

8. GENERAL PROVISIONS

 

8.1. Smart Shark Creative Studio reserves the right, at any time, to modify these Terms of Use and its Privacy Policy and impose new or additional terms or conditions on your use of the application. Such modifications and additional terms and conditions will be effective immediately and will be incorporated into these Terms.

 8.2. If any term or condition of our Agreement is held to be invalid, illegal or unenforceable, the parties agree that such term or condition may be terminated and the remainder of the Agreement shall continue in effect indefinitely.

 8.3. Smart Shark Creative Studio may, without prior notice, block and cancel access to the application when it verifies that the User has performed any act or maintain conduct that (i) violates federal, state and/or municipal laws and regulations, (ii) contravenes the rules of these Terms of Use, or (iii) violates the principles of morality and good customs.

  8.4. These Terms of Use and Privacy Policy will be governed and interpreted in accordance with the laws of Brazil. To resolve any doubts about this instrument, as well as any event related to the use of our services, the Central Forum of the Capital District of the State of São Paulo is elected to resolve any issues arising from these Terms of Use.

Termos de Uso de Aplicativo

 

A seguir estão descritas as regras aplicáveis à utilização do App Fly Butterfly disponibilizado pela Smart Shark Creative Studio, sediada na cidade de Guarulhos, (doravante “Smart Shark Creative Studio”), em dispositivos móveis com sistemas Android inicialmente.

 Ao realizar o cadastro para utilização do Aplicativo, o Usuário se submeterá automaticamente às regras e condições deste Termos de Uso.

 

1.DEFINIÇÕES

 1.1. App ou aplicativo móvel: é um software desenvolvido para ser instalado em dispositivo eletrônico móvel, como um telefone celular, um smartphone.  Este aplicativo pode ser instalado no dispositivo, se o aparelho permitir e desde que baixado pelo usuário através de uma loja on-line, tais como Google Play ou Apple Store, entre outras.

 1.2. Android: é sistema operacional para dispositivos móveis, desenvolvido pelo ‘’Open Handset Alliance’’, liderada pelo Google.

 1.3. iOS: é um sistema operacional móvel da Apple Inc desenvolvido originalmente para o iPhone.

 1.4. Tecnologia Push: é um sistema de distribuição de conteúdo da Internet em que a informação sai de um servidor para um cliente, com base em uma série de parâmetros estabelecidos pelo cliente, também chamado de “assinatura”. No caso deste Termo de Uso trata-se de conteúdo a ser encaminhado como alertas, lembretes ou mensagens ao usuário que tiver o aplicativo Fly Butterfly instalado.

 1.5. Usuários: Todas as pessoas, sem restrição, poderão baixar e usar o aplicativo Fly Butterfly. Os Usuários terão acesso aos recursos:

•           Tela de entrada;

•           Tela de loja com itens para aquisição;

•           Cena do game.

  

2.DA BAIXA (DOWNLOAD) DO APP FLY BUTTERFLY

 2.1. Para que o usuário possa baixar o aplicativo em seu aparelho celular, deverá se certificar se possui o Android. Não haverá outra forma de acessar o App Fly Butterfly que não seja pelo smartphone.

 2.2. O “Termo de Uso e Política de Privacidade” aos usuários, está presente nos links e o usuário poderá revisá-los a qualquer momento.

 

3.DA GRATUIDADE E COBRANÇA DO APP FLY BUTTERFLY

 3.1. Para a utilização e baixa (download) do App Fly Butterfly não haverá custo nenhum, tampouco para eventuais atualizações.

 3.2. Caso o usuário queira adquirir os produtos contidos na loja dentro do aplicativo, deverá efetuar a compra diretamente pelo aplicativo, respeitando as políticas de privacidade e termos de compra do google que pode ser acessado clicando nesse link Google Play Services.

 

4.DO CADASTRO E USO DO APP FLY BUTTERFLY

 4.1. No momento não se faz necessário qualquer cadastro para utilização do aplicativo, porém em atualizações futuras poderá haver mudanças na forma de acesso ao aplicativo afim de melhorar a experiência do usuário.

 4.2. Futuramente o usuário que realizar o cadastro sobre suas informações pessoais será o responsável pelo correto preenchimento e manutenção das referidas informações. O “Cadastro” é composto por dados obrigatórios tais como nome, email e senha de acesso ao aplicativo Fly Butterfly.

 4.3. Será permitido um único cadastramento por Usuário, devendo o acesso, visualização e uso do Aplicativo ser feito pelo Usuário em caráter pessoal e intransferível.

 4.4. No caso de menores de 18 (dezoito) anos ou outras pessoas que necessitem de representação na forma da lei, o cadastramento deverá ser realizado com a assistência dos pais ou dos representantes legais.

 4.5. Não é de responsabilidade da Smart Shark Creative Studio o caso de um Usuário se utilizar do cadastro de outro usuário.

 4.6. Toda e qualquer ação executada ou conteúdo publicado pelo Usuário durante o uso do aplicativo será de sua exclusiva e integral responsabilidade, devendo isentar e indenizar a Smart Shark Creative Studio de quaisquer reclamações, prejuízos, perdas e danos causados, em decorrência de tais ações ou manifestações.

 4.7. O Usuário autoriza a Smart Shark Creative Studio ou terceiros por ela indicados, a utilizar, por prazo indeterminado, as informações fornecidas no ato do cadastro e durante o uso do aplicativo, para fins estatísticos e envio de material publicitário, newsletters, informes, etc.

 4.8. A Smart Shark Creative Studio se reserva o direito de incluir, excluir ou alterar os conteúdos e funcionalidades do aplicativo, bem como suspendê-lo temporariamente ou cancelá-lo, a qualquer momento, independentemente de aviso prévio ao Usuário. Da mesma forma, poderá modificar estes Termos de Uso, cuja versão mais recente estará sempre disponível para consulta pelo link ou direto no aplicativo.

 4.9. A Smart Shark Creative Studio se exime de toda e qualquer responsabilidade pelos danos e prejuízos de qualquer natureza que possam decorrer do acesso, interceptação, eliminação, alteração, modificação ou manipulação, por terceiros não autorizados, dos dados do usuário durante a utilização do aplicativo.

 4.10. As informações solicitadas ao Usuário no momento do cadastro serão utilizadas pela Smart Shark Creative Studio somente para os fins previstos nestes Termos de Uso e em nenhuma circunstância, tais informações serão cedidas ou compartilhadas com terceiros, exceto por ordem judicial ou de autoridade competentes.

 

5.RENÚNCIA A GARANTIAS E LIMITAÇÃO DE RESPONSABILIDADE

 

 5.1. A Smart Shark Creative Studio responde pelos seus serviços e pelo gerenciamento do aplicativo em relação aos usuários, porém, a qualidade e quantidade dos produtos e serviços oferecidos por nossos parceiros é de responsabilidade exclusiva destes últimos.

 5.2. O Usuário é responsável pela(s) atualização(ões) do App Fly Butterfly. Caso não o faça e tiver problema na sua utilização, a Smart Shark Creative Studio estará isenta de responsabilidade por quaisquer perdas e danos.

 5.3. A Smart Shark Creative Studio não declara ou garante que o Aplicativo será livre de perdas, defeitos, ataques, vírus, interferências, atividades de hackers ou outra intrusão de segurança, e a Smart Shark Creative Studio renuncia a qualquer responsabilidade com relação a isso por ser culpa de terceiros.

            6.DA PROPRIEDADE INTELECTUAL

 

6.1. O Usuário concorda que os serviços prestados pela Smart Shark Creative Studio, incluindo, sem limitação, o Aplicativo com interface de usuário, integração com outros serviços ou aplicativos, scripts e software utilizados para implementá-lo contêm informações exclusivas de propriedade da Smart Shark Creative Studio e/ou seus licenciantes e são protegidos pelas leis de propriedade intelectual e outras leis aplicáveis, incluindo, sem limitação, direitos autorais.

 6.2. O Usuário concorda que não utilizará tais informações ou materiais exclusivos de nenhuma forma, exceto para uso dos Serviços em conformidade com este Termo de Uso. Nenhuma parte dos serviços poderá ser reproduzida de qualquer forma ou por qualquer meio, exceto conforme expressamente permitido por estes termos.

 6.3. Sem prejuízo de qualquer disposição deste Termo, a Smart Shark Creative Studio e seus representantes se reservam o direito de alterar, suspender, remover ou desabilitar o acesso ao aplicativo, conteúdos ou outros materiais, a qualquer momento, sem aviso ou ônus. Em hipótese alguma, a Smart Shark Creative Studio será responsabilizada por ter realizado tais alterações. A Smart Shark Creative Studio poderá ainda impor limites sobre o uso de ou acesso a determinadas funcionalidades ou partes do serviço do aplicativo, em qualquer caso e sem aviso ou responsabilidade.

 6.4. Todos os direitos autorais relacionados ao Fly Butterfly e software relacionados são de propriedade da Smart Shark Creative Studio ou seus licenciantes, que reservam todos os seus direitos previstos em lei e equidade. A utilização do software ou qualquer parte dos serviços do App Fly Butterfly, exceto para o uso permitido neste termo, é estritamente proibida e viola os direitos de propriedade intelectual de terceiros, podendo sujeitá-lo a penalidades civis e criminais, incluindo possíveis danos patrimoniais por violação de direitos autorais.

 

7.DO CANCELAMENTO

 

7.1. O usuário poderá, a qualquer tempo, desinstalar o App Fly Butterfly, sem que isto gere para qualquer das partes o direito de indenização ou qualquer outra quantia.

 

7.2. Sem prejuízo das demais sanções legais e daquelas aqui previstas, a Smart Shark Creative Studio poderá, a seu critério, notificar, suspender e/ ou cancelar o cadastro do Usuário, rescindir o presente Termo e/ ou Conta, revogar a licença do software, impedir o acesso ao aplicativo (ou qualquer parte dele) a qualquer tempo, definitiva ou temporariamente, nos seguintes casos, exemplificando, mas não se limitando:

 

1.a) Descumprimento de quaisquer disposições deste Termo de Uso;

2.b) Verificação de cadastro duplicado;

3.c) Verificação de novo cadastro realizado por Usuário que teve seu cadastro cancelado e/ou suspenso;

4.d) Constatação de fraude ou tentativa de fraude; e/ ou,

5.e) Fornecimento de informações solicitadas incorretas e/ ou inverídicas ou ainda se negar a prestar eventuais informações adicionais solicitadas pelo Site.

 7.3. Com o término, por qualquer motivo, da relação entre a Smart Shark Creative Studio e o Usuário.

 7.4. A Smart Shark Creative Studio reserva o direito de alterar, suspender ou interromper o App Fly Butterfly (ou qualquer parte ou conteúdo) a qualquer tempo, com ou sem aviso prévio, e a Smart Shark Creative Studio não será responsável perante o Usuário ou qualquer terceiro caso exerça tais direitos.

 

8.DISPOSIÇÕES GERAIS

 

8.1. A Smart Shark Creative Studio reserva o direito de, a qualquer tempo, modificar o presente Termo de Uso e de sua Política de Privacidade e impor termos ou condições novos ou adicionais sobre seu uso do aplicativo. Tais modificações e termos e condições adicionais terão eficácia imediata e serão incorporados a este Termo.

 8.2. Se qualquer termo ou condição do nosso Acordo for considerado inválido, ilegal ou inaplicável, as partes concordam que tal termo ou condição poderá ser excluído e o restante do Acordo deverá continuar em vigorando por prazo indeterminado.

 8.3. A Smart Shark Creative Studio poderá, sem prévio aviso, bloquear e cancelar o acesso ao aplicativo quando verificar que o Usuário praticou algum ato ou mantenha conduta que (i) viole as leis e regulamentos federais, estaduais e/ou municipais, (ii) contrarie as regras destes Termos de Uso, ou (iii) viole os princípios da moral e dos bons costumes.

 8.4. Este Termo de Uso e Política de Privacidade serão regidos e interpretados de acordo com as leis do Brasil. Para dirimir eventuais dúvidas acerca do presente instrumento, bem como qualquer evento relacionado à utilização de nossos serviços, fica eleito o Foro Central, da Comarca da Capital do Estado do São Paulo para dirimir quaisquer questões decorrentes destes Termos de Uso.
